I'd rather avoid the pr_err() in the -EBUSY case. What about:

if (err) {
        if (err == -EBUSY)
                pr_info("Unable to init device /dev/mcelog, already 
registered");
        else
                pr_err("Unable to init device /dev/mcelog (rc: %d)\n", err);
}
