I'm currently on a vanilla 3.8.2 kernel because this is the only >3.4 kernel I found which doesn't give me this issue: http://lists.xen.org/archives/html/xen-users/2013-02/msg00114.html

So I would assume that the kernel should be new enough to handle that. On the other hand, as far as I understand the whole process, the kernel itself will only deal with the vga card if it is actually bind to the dom0 / to it's driver which it is not. Is there any way to test either if the ask-command from xl is really executed on dom0 or to test this command manually?

Btw: Hardware is a Radeon HD 5750 and a Radeon HD 5400..
